Privacy Policy
Who we are
This Privacy Policy describes how Sagar Aggarwal, a sole proprietorship in India trading as ScaleMax Cloud ("we", "us"), collects and uses personal data when you register, buy, or run a KVM VPS, with any image we offer (Ubuntu, AI agent box or n8n). Customer virtual machines run on dedicated AMD EPYC hardware in Gravelines, France (EU). We intend to handle personal data in line with India's Digital Personal Data Protection Act, 2023 (DPDP Act) and the rules notified under it as they apply to a sole-proprietor hosting business of this size. Read this with our Terms of Service.
Data we collect
We collect what we need to sell and run the service: the name and email address you submit at registration or checkout; billing records (plan, amount, currency, timestamps, invoice and order identifiers, payment status, and processor references); instance metadata (hostname, plan size, resource counters we need to operate NAT and KVM, power state, and lifecycle events such as create, suspend, and destroy); and support messages you send us. When you pay through Cashfree, we receive what Cashfree sends to confirm or fail a payment — typically a payment id, method type, and status. When you pay by UPI QR, we record the UTR (transaction reference) you submit. We do not store full card numbers on ScaleMax Cloud.
Files, databases, n8n workflows, and application logs that live only on your virtual disk are content you control. We may take a hypervisor-level snapshot for operations (migration or suspected disk failure) and we may inspect traffic metadata or disk when we have a credible abuse report, a legal demand, or a need to keep the platform network from being blocked. New servers include one ScaleMax Cloud support SSH key so we can help when you ask; it is listed under Rescue → SSH keys on your server page, you can remove it at any time, and we do not log in unless you ask or it is needed to stop abuse or a security incident.
Processors and no sale of data
Cashfree processes UPI, card, net banking and wallet payments. UPI QR payments go from your UPI app to our UPI account through your bank. Our infrastructure in Gravelines, France (EU) processes instance disks, network allocations, and the environment in which your KVM guest runs. We use an email provider to send transactional mail such as login links, invoices, suspension notices, and support replies. We do not sell personal data to brokers, advertisers, or data cooperatives, and we do not rent our customer list.
Cookies
The ScaleMax Cloud website and dashboard use cookies only for session authentication: to recognise a logged-in browser after you sign in, and to keep that session until you log out or the session expires. We do not run third-party advertising pixels, cross-site tracking cookies, or analytics cookies as part of the core product described here.
Retention
Account data (identity, billing history, instance metadata, and support threads) is kept while the account is active and for ninety (90) days after you close it or we terminate it, unless a longer period is required for a refund, tax record, dispute, or lawful request. After an instance is cancelled or terminated, virtual-disk contents follow the seven-day deletion window in the Terms. Backups inside the guest, and any backup add-on you configure, run on your own schedule and retention; we do not keep a separate forever-archive of your application data.
Your rights
Consistent with the DPDP Act, 2023, you may request access to the personal data we hold about you, correction of inaccurate data, and deletion of data we no longer need for the service or the law. Send these requests through dashboard support from the email on the account so we can verify it is you. We will not fulfil a deletion demand in a way that erases fraud or AUP evidence we must retain. Because guest VMs are in Gravelines, France, instance content is stored outside India; you instruct that transfer by buying the product. Complaints may be raised with Sagar Aggarwal first, at support@scalemaxcloud.com, and with the Data Protection Board of India as that forum operates under the Act.
