Acceptable Use Policy
Purpose
This Acceptable Use Policy ("AUP") is part of your contract with Sagar Aggarwal, trading as ScaleMax Cloud. It applies to every KVM VPS plan, with any image we offer (Ubuntu, AI agent box or n8n), and every network resource we provide. You are responsible for traffic that originates from your instance, including software you install, automations you run, and anyone you allow to use the machine. If this AUP conflicts with the Terms of Service on a use restriction, this AUP controls.
Prohibited uses
You may not use ScaleMax Cloud, or allow it to be used, for any of the following. Attempts and tooling built for these purposes are treated the same as the completed act.
- Spam and bulk unsolicited mail, including purchased lists and using our IP space as a relay. Outbound TCP port 25 is blocked by default. We may open it on written request if you give a specific, lawful justification (for example transactional mail for an application you operate) and keep complaint rates acceptable. Opening port 25 is a revocable privilege, not a plan feature.
- Distributed denial-of-service attacks, reflection or amplification, port scanning of third-party networks, booter or stresser services, and any product whose purpose is to degrade or probe systems you do not own or have written permission to test.
- Proof-of-work mining, mining pools, and similar sustained hashing load, including idle mining on an AI agent box. These workloads starve other customers and are banned regardless of plan size.
- Content or activity that is illegal under Indian law, including material that violates the Information Technology Act, 2000, financial fraud, and content a competent Indian authority has ordered taken down.
- Child sexual abuse material (CSAM) and any sexual content involving minors. We will terminate immediately, preserve what we reasonably must, and report to appropriate authorities. There is no warning, refund, or grace period for CSAM.
- Hosting or operating malware, ransomware command-and-control, phishing kits, or credential-harvesting pages. n8n workflows and agent automations that send phishing or steal credentials are treated as malware.
- Reselling, subletting, or providing access to your instance, panel login, or allocated resources to third parties as a commercial hosting product without our prior written consent.
How we handle abuse
On a credible report from a complainant, payment processor, or our own monitoring, we may suspend network access or the instance first and investigate second. A single abused VM can get the whole platform null-routed. We aim to respond to the customer of record within twenty-four (24) hours of a suspension or a substantiated abuse ticket, using the email on the account. You must reply with enough detail for us to restore service, keep the suspension, or terminate.
You remain liable for your users, contractors, bots, and workflows. If we terminate for AUP violation, prepaid time is not refunded under the Refund & Cancellation Policy. Severe violations, including CSAM and DDoS-for-hire, may be reported to our network operators, processors, and law enforcement. To report abuse of a ScaleMax Cloud hostname, write to support@scalemaxcloud.com with timestamps, source hostnames, and sample logs. The operator is Sagar Aggarwal.
